1. Introduction & Acceptance

Welcome to Hacker Relay! The Hacker Relay website(https://hackerrelay.com) (the “Site”) is comprised of various web pages operated by Hacker Relay, Inc.(“Hacker Relay,” “we,” or “us”). Hacker Relay is a Delaware corporation with its principal place of business in Palo Alto, California.

By accessing or using our Site and/or related services, applications, and tools (collectively, the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree with these Terms, do not use or access the Service.

2. Description of Services

Hacker Relay provides a SaaS platform that delivers data and insights about the job market, primarily for web developers (the “Services”). All content and resources provided via the Site are for informational purposes only, and Hacker Relay does not guarantee the accuracy, reliability, or timeliness of any data.

3. Privacy & Data Protection

Your use of the Site and the Services is subject to Hacker Relay’s Privacy Policy. Our Privacy Policy explains how we collect, use, share, and protect your information. We use various security measures (such as encryption, anonymization, and access controls) to protect your personal data. We will not share your personal information with third parties except as required by law or as necessary to provide Services to you.

By using our Site or Services, you acknowledge that you have reviewed and agree to the practices outlined in our Privacy Policy.

Visiting the Site or sending emails to Hacker Relay constitutes electronic communications. In order to access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your computer or device. You agree to accept responsibility for all activities or actions that occur under your account.

Hacker Relay reserves the right, at our sole discretion, to refuse service, suspend, or terminate accounts, or remove or edit content for any reason.

6. Eligibility; Children Under Thirteen

The Services are not directed at children under the age of 13. Hacker Relay does not knowingly collect personal information from persons under the age of 13. If you are under 18, you may use https://hackerrelay.com only with the permission of a parent or legal guardian.

7. Subscriptions, Payments, & Refunds

Certain Services provided by Hacker Relay may require a subscription and/or payment. You agree to pay all applicable fees for these Services as described at the time of purchase.

Cancellation/Refund Policy: You may cancel your subscription or order within 10 days of purchase. Any cancellations made after 10 days of service will not qualify for a refund. If you need to request a refund, please contact us at contact@hackerrelay.com.

8. Intellectual Property; No Unlawful or Prohibited Use

All content, materials, features, and functionality on the Site (including but not limited to text, graphics, logos, images, and software) are the exclusive property of Hacker Relay or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services strictly in accordance with these Terms.

You agree not to use the Site or Services for any purpose that is unlawful or prohibited by these Terms. You may not use the Site or Services in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use of the Site.

9. User Content & Feedback

Where applicable, you may be able to submit, post, or otherwise make available content, including but not limited to reviews, comments, or feedback (collectively, “User Content”). You represent and warrant that your User Content does not violate the rights of any third party, is accurate, and does not contain unlawful material.

By posting User Content on the Site, you grant Hacker Relay a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, and display your User Content in connection with operating and marketing the Services.

10. Links to Third-Party Sites; Third-Party Services

The Site may contain links to other websites (“Linked Sites”). Hacker Relay is not responsible for the contents, performance, or practices of any Linked Site. Inclusion of a link does not imply endorsement by Hacker Relay.

Certain services made available through the Site are delivered by third-party sites and organizations. By using any product, service, or functionality originating from the Site, you acknowledge and consent that Hacker Relay may share such information and data with any third party with whom Hacker Relay has a contractual relationship to provide the requested product, service, or functionality.

11. International Users

The Services are controlled, operated, and administered by Hacker Relay from its offices within the United States. If you access the Services from a location outside the United States, you are responsible for compliance with all local laws. You agree that you will not use the Site or its content in any country or in any manner prohibited by applicable laws or regulations.

12. Disclaimers & Limitations of Liability

Disclaimer of Warranties: The Site and Services are provided “as is” and “as available,” without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Hacker Relay does not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any information obtained through the Services will be accurate or reliable.

Limitation of Liability: To the fullest extent permitted by law, in no event shall Hacker Relay, its affiliates, or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in any way connected with your use of or inability to use the Site or the Services.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hacker Relay, its officers, directors, employees, agents, and affiliates from and against any and all losses, liabilities, claims, or demands (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

14. Dispute Resolution & Arbitration

Any dispute or claim arising out of or relating to these Terms or your use of the Services (including non-contractual disputes or claims) shall be settled by binding arbitration under the Federal Arbitration Act. The arbitration shall be conducted before a single arbitrator under the rules of the American Arbitration Association. Class arbitrations are not permitted.

The arbitrator’s decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

15. Termination & Access Restriction

Hacker Relay reserves the right, in its sole discretion, to terminate your access to the Site or the Services or any portion thereof at any time, without notice. Causes for such termination may include, but are not limited to, your breach of these Terms or any other policies referenced herein.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of these Terms, other than arbitration proceedings, shall be instituted exclusively in the federal or state courts located in Santa Clara County, California.

17. Changes to Terms

Hacker Relay reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms at any time. The most current version of these Terms will supersede all previous versions. We encourage you to periodically review the Terms to stay informed of our updates.
